Elite Water Polo ABN 80 578 548 970 (Elite Water Polo) will supply the Services on the terms and conditions set out below.
1. Introduction
Welcome to Elite Water Polo. These Terms and Conditions ("Agreement") govern your participation in water polo training sessions, camps, and related activities (the "Training" or "Activity") provided by Elite Water Polo. By registering, booking, or participating in any water polo training session, you agree to be bound by these Terms and Conditions.
2. Eligibility and Registration
  • Age and Experience Requirements: Water polo training is open to individuals of all age. Participants must be able to swim at least 50 meters unassisted and be familiar with basic water safety practices.
  • Registration: All participants must complete a registration form prior to attending any water polo training session. You agree to provide accurate and up-to-date information during the registration process.
  • Parental Consent: If the participant is under the age of 18, written consent from a parent or legal guardian is required for participation.
3. Assumption of Risk
  • Acknowledgement of Risk: You acknowledge that water polo is a physically demanding and high-contact sport that involves inherent risks, including, but not limited to, physical injury (e.g., sprains, fractures, bruises, and cuts), drowning, equipment malfunction, or other accidents in or around water.
  • Voluntary Participation: By participating in the Training, you understand and voluntarily assume all risks associated with the Activity, including those arising from the actions or negligence of others or from the conditions of the water, pool, or facilities used during the Training.
  • Medical Fitness: You affirm that you are in good health and physically capable of participating in water polo training. If you have any concerns about your health, fitness, or ability to participate, you agree to consult a healthcare provider before attending a training session.
  • Swimming Ability: You acknowledge that the Training takes place in deep water, and you must be comfortable in the water and capable of swimming without assistance. You also agree to notify the coach or staff of any swimming limitations or medical conditions that may affect your participation.
4. Code of Conduct
  • Respectful Behavior: All participants are expected to show respect for fellow players, coaches, and staff. This includes refraining from inappropriate behaviour, verbal abuse, or misconduct during the Training.
  • Following Instructions: Participants must follow all safety and training instructions given by Elite Water Polo's coaches and staff. Disregard for instructions or unsafe behaviour may result in immediate removal from the Training session.
  • Equipment Use: Participants must use training equipment responsibly and ensure that all equipment (e.g., balls, goals, caps) are used according to guidelines set by the coach or staff.
5. Health and Safety
  • Water Safety: Water polo training will take place in a pool with specific depth levels. All participants must follow safety protocols related to pool use, including not diving into shallow areas, ensuring proper warm-up before entering the water, and leaving the pool area when instructed.
  • Safety Equipment: While safety equipment (e.g., caps, mouthguards) is not always required, you agree to use any equipment provided by Elite Water Polo as directed for your safety during training.
  • Emergency Procedures: In the event of an emergency, Elite Water Polo will follow the standard emergency procedures. Emergency medical treatment may be provided if necessary. By participating, you consent to the administration of first aid and emergency medical care in case of an accident or injury.
6. Liability Waiver and Release
To the fullest extent permitted by law, you agree to waive, release, and hold harmless Elite Water Polo, its officers, employees, agents, contractors, and affiliates from any and all liability for injuries, damages, losses, claims, or causes of action, including those arising from negligence, resulting from your participation in the water polo training sessions.
7. Cancellation and Refund Policy
  • Cancellations by Participant: If you are unable to attend a scheduled water polo training session/camp, you may cancel your participation with at least 72 hours' notice to receive a credit. Note: Whether you’re dealing with an injury, health issue, or personal emergency, we encourage you to communicate with us as soon as possible, and we will do our best to accommodate your needs.
  • Cancellations by Elite Water Polo: If a training session is cancelled or rescheduled due to unforeseen circumstances (e.g., weather, facility issues, coach unavailability), you will be offered a full refund or the option to reschedule to a future session.
  • No-show Policy: If you fail to attend a training session without prior notice, no refund or credit will be provided.
8. Photography and Media Release
By participating in the water polo training, you consent to Elite Water Polo capturing photographs, videos, or other media during the session. These may be used for promotional purposes, including on social media, websites, and other marketing materials. If you do not wish to be included in such media, please notify the coach or staff before the training session.
9. Privacy and Data Protection
  • Elite Water Polo respects your privacy and will handle your personal data in accordance with applicable privacy laws. For further details, please refer to our Privacy Policy available on our website.
  • Personal information provided during registration will be used for the purpose of managing your participation in the training sessions and will not be shared with third parties unless required by law.
10. Modifications to the Terms and Conditions
Elite Water Polo reserves the right to update or modify these Terms and Conditions at any time. Changes will be communicated to participants via email or posted on our website. Continued participation in the Training after such changes constitutes your acceptance of the revised Terms and Conditions.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of NSW. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Sydney.
